Per Arnesh Kumar v. State of Bihar, (2014) 8 SCC 273, the police must record reasons under §41A CrPC before effecting arrest in such offences. The investigating officer's order dated 12 October 2024 ¶4 records no such reasons. Satender Kumar Antil v. CBI, (2022) 10 SCC 51 reaffirms this position and lays down categories for grant of bail, which the present matter falls within (Category A).

It is therefore prayed that this Hon'ble Court may be pleased to release the accused on bail on such terms as it deems fit.
